Redress Schemes For Personal Injuries Civil Justice Systems
Personal injuries can be devastating, both physically and emotionally. When accidents happen, it is important to have a system in place that allows victims to seek justice and receive fair compensation for their suffering. This is where redress schemes for personal injuries play a crucial role in civil justice systems.
Understanding Redress Schemes
Redress schemes are designed to provide a streamlined and efficient process for resolving personal injury claims. These schemes offer an alternative to traditional litigation, which can be time-consuming, costly, and emotionally draining for victims.
Under a redress scheme, victims are encouraged to submit their claim to an independent body rather than pursuing a legal action in court. This body, often referred to as the redress authority, assesses the claim and determines the appropriate amount of compensation based on established guidelines and criteria.

One of the main advantages of redress schemes is their focus on providing timely compensation to victims. Traditional litigation can drag on for years, causing further distress to already suffering individuals. Redress schemes aim to expedite the process, ensuring that victims receive the compensation they deserve without unnecessary delays.
The Benefits of Redress Schemes
There are several benefits to implementing redress schemes within civil justice systems:
1. Accessibility
Redress schemes make justice more accessible to a wider range of people, including those who may not have the financial means or resources to pursue traditional legal actions. By lowering the barriers to entry, redress schemes ensure that victims have a fair chance of seeking redress for their injuries.
2. Speed and Efficiency
As mentioned earlier, redress schemes offer a much faster resolution compared to traditional litigation. Victims receive compensation in a timely manner, allowing them to move on with their lives and focus on their recovery.
3. Lower Costs
Litigation can be expensive, with legal fees, court expenses, and other related costs. Redress schemes often eliminate or significantly reduce these expenses, making it a more cost-effective option for victims.
4. Compensation Standards
Redress schemes typically establish clear guidelines for assessing compensation amounts. This ensures consistency and fairness in awarding compensation, as well as avoiding potential bias from sympathetic juries or judges.
5. Confidentiality
Some victims may prefer to keep their personal information private, especially in sensitive personal injury cases. Redress schemes can provide a level of confidentiality, protecting the identity of victims while still allowing them to seek compensation.
Examples of Redress Schemes
Redress schemes have been successfully implemented in various jurisdictions around the world. Here are a few examples:
1. New Zealand Accident Compensation Corporation (ACC)
The ACC is a government-run redress scheme that provides compensation for personal injuries suffered in New Zealand, regardless of fault. The scheme covers medical expenses, rehabilitation, and income support for victims. It also focuses on accident prevention and public education to reduce the overall number of injuries.
2. United Kingdom Motor Insurers' Bureau (MIB)
Established in the UK, the MIB provides compensation for victims involved in accidents with uninsured or untraced motorists. The scheme operates by compensating victims directly, ensuring that they receive financial support even if the responsible party cannot be identified or does not have insurance.
3. Australia National Redress Scheme (NRS)
The NRS was established to provide compensation to victims of institutional child sexual abuse. It offers support services, financial compensation, and access to counseling for survivors. The scheme aims to acknowledge the harm suffered by victims, hold institutions accountable, and prevent future abuse.
The Future of Redress Schemes
As awareness grows around the benefits of redress schemes, more jurisdictions are considering their implementation. The focus is shifting towards providing victims with a fair and accessible process that prioritizes their well-being and recovery.
However, challenges still exist, such as ensuring the independence and transparency of redress authorities, establishing adequate funding, and addressing the specific needs of different types of personal injury cases. It is crucial for policymakers, legal professionals, and community members to continue working together to refine and improve redress schemes for the benefit of all.
Redress schemes for personal injuries offer an alternative and more accessible path to justice for victims. By streamlining the process, providing timely compensation, and reducing costs, these schemes aim to empower individuals and help them recover from their traumatic experiences.
As the number of jurisdictions implementing redress schemes continues to grow, it is important to ensure their effectiveness and fairness. Redress schemes have the potential to transform civil justice systems and provide a more compassionate and efficient approach to resolving personal injury claims.

This ground-breaking book takes a fresh look at potential non-litigation solutions to providing personal injury compensation. It is the first systematic comparative study of such a large number – over forty – of personal injury compensation schemes. It covers the drivers for their creation, the frameworks under which they operate, the criteria and thresholds used, the compensation offered, the claims process, statistics on throughput and costs, and analysis of financial costings. It also considers and compares the successes and failings of these schemes.
Many different types of redress providers are studied. These include the comprehensive no-blame coverage offered by the New Zealand Accident Compensation Corporation; the widely used Patient, Pharmaceutical, Motor Accident and Workers Compensation Insurance systems of the Nordic states; the far smaller issue-focused schemes like the UK Thalidomide and vCJD Trusts; vaccine damage schemes that exist in many countries; as well as motor vehicle schemes from the USA.
s are drawn about the functions, essential requirements, architecture, scope, operation and performance of personal injury compensation systems. The relationships between such schemes, the courts and regulators are also discussed, and both calls and need for reforms are noted.
Noting the wide calls for reform of NHS medical negligence litigation within the UK, and its replacement with a no blame approach, the authors' findings outline options for future policy in this area. This major contribution builds on general shifts from courts to ADR, and from blame to no blame in regulation, and is a work that has the potential to have a major impact on the field of personal injury redress.
